This Privacy Policy describes the type of information that Movies Anywhere, LLC ("Movies Anywhere", "we", or "us") collects from and about you when you access or use the Movies Anywhere website, moviesanywhere.com, download or use the Movies Anywhere mobile or other application, or use or access any of our other services, features, tools, or materials offered from time to time by Movies Anywhere and where the Movies Anywhere Privacy Policy is posted (the "Services"). It also explains how we handle and may share or disclose information collected through the Services, as well as your ability to control certain uses of it.

1. Information We Collect

Information You Provide

We collect information from you in connection with the Services, including:

  1. Registration or profile information: When you register or create a profile through the Services, we may collect information such as your name, gender, age or date of birth, email address, username, and password.
  2. Activity information: When you access or use the Services on one or more devices, request information from us, sign-up for our newsletters or email list, access an offer we may provide, participate in a Movies Anywhere sweepstakes or other Promotions, fill out a survey, post content or comments to the Services, request customer support or otherwise contact us, we may collect information including your email address, postal address, and telephone or mobile number.
  3. Digital Retailer account information: When you connect a Digital Retailer to the Services we may collect identifying information about you, such as your user ID or username, from that platform, as well as information about your interactions with the Digital Retailer account, including your videos associated with that Digital Retailer Account.
  4. Public Information. When you publicly post or share comments, content, or other information to the Services, we may collect information about you that accompanies such posts, including your user ID, or username, email address, and avatar.

Information Automatically Disclosed

We and certain Service Providers operating on our behalf may use a variety of technologies such as cookies, web beacons, pixel tags, log files, HTML5 cookies, application program interfaces, software development kits, or other technologies to automatically collect certain information about visitors to, and users of, the Services, as well as users who interact with our emails and online and mobile advertisements. For example, the information we may automatically collect may include, but is not limited to:

  1. Technical and device information, including your browser or device type, unique identifier of any of your computer(s), mobile device(s), or other device(s) used to access or use the Services, IP address, mobile device model, mobile device operating system, and streaming URL.
  2. Usage information, including the date and time you visit the Services, the areas or pages of the Services that you visit, the amount of time you spend viewing or using the Services, the number of times you return to the Services, other site or app usage data (such as when you link to a Digital Retailer or other third-party service), and emails or other communications that you open, forward or click-through to our site. If you access your Movies Anywhere account on multiple devices or browsers, we may associate your usage information across one or more devices with your Movies Anywhere account.
  3. Video activity information, such as your video titles, video descriptions (e.g., episode, or genre descriptions), and other video activity information, such as your video browsing or search history; your video views; your video purchases, rentals, or redemptions; and your engagement with videos (e.g., your video favorites).
  4. Location information, when you access or use the Services, including location information either provided by a mobile device interacting with the Services (including through beacon technologies), or associated with your IP address, where we are permitted by applicable law.

Information from Other Sources

We may acquire information from other trusted sources to update or supplement the information you provided or that we collected automatically. Our use of any information we acquire about you shall remain consistent with the Movies Anywhere Privacy Policy.

Combination and Tracking of Information

We may combine, link, and track the information we receive from and about you through your access or use of the Services, as well as the information that we may collect and acquire: offline, across computers, mobile or other devices (such as tablets, set-top-boxes, or over-the-top devices (e.g., Roku)) that you may use, your public information from social media and other third party services, and from other sources.

2. Use of Your Information

We may use the information we collect from or about you for any of the following purposes:

  1. To respond to your inquiries, provide you with the Services, process your orders or fulfill your requests, provide you with notices about your account and changes to our policies, and to contact and communicate with you when necessary or as otherwise allowed by the Movies Anywhere Privacy Policy;
  2. To enhance your experience and provide you with customized content and messaging on the Services, including providing you with personalized or localized content, recommendations about videos and other features on the Services that you might enjoy, and to identify and link to your account across devices that you may use to access the Services;
  3. To provide you with personalized offers and advertising on and off the Services, including via email, in-app messaging or push notifications, or across other websites, mobile applications, devices, social media or third-party services that you use;
  4. To contact you with information, newsletters, promotional emails, in-app messages, push notifications, promotional opportunities, advertisements, or consumer surveys from us and/or on behalf of Digital Retailers, Participating Studios, and our other partners, and affiliates;
  5. To administer promotions that you have chosen to participate in;
  6. To provide, optimize, measure, or improve the Services, content, products, videos, and operations;
  7. To use your data in an aggregated or de-identified format for analytical, demographic, marketing, or other similar purposes;
  8. Detect, investigate and prevent activities that may in our sole discretion violate our policies or be illegal;
  9. To carry out our obligations and enforce our rights arising from any contracts entered into between you and us; and
  10. For other purposes disclosed at the time you provide your information or otherwise with your consent.

3. Sharing Your Information

We may share the information we collect from and about you in the following ways:

  1. With Participating Studios: Movies Anywhere may share your Video Data (see Section 4 of the Movies Anywhere Privacy Policy) with current or future participating Movies Anywhere Studios (collectively, "Participating Studios"), with your consent. In addition, Movies Anywhere may share any of the information we collect from and about you as described in the Movies Anywhere Privacy Policy with Participating Studios, including information about your registration, profile, activity and usage of the Services, your public information, technical and device data, location information, and any other information we may collect or acquire about you, including your different devices. Participating Studios that receive your data will use such data in accordance with their respective privacy policies, including to deliver you more relevant and interesting content, marketing, advertisements, and promotions, and to improve their services and products.
  2. With Digital Retailers: We may share your information with Digital Retailers that you connect with the Services. This includes, but may not be limited to, Apple iTunes, Amazon Prime Video, Fandango at Home, Google Play/YouTube, Microsoft Movies & TV, Xfinity, Verizon Fios TV and DIRECTV, or any future participating Digital Retailers. Digital Retailers that receive your data will use such data in accordance with their respective privacy policies.
  3. With Affiliates: We may share your information with our affiliates for purposes consistent with the Movies Anywhere Privacy Policy.
  4. With Service Providers: We may share your information with third-party Service Providers that assist us with certain aspects of the Services, including customer service, analytics, marketing, advertising, personalization, communications with you, and operation of the Services. These Service Providers may use the information to provide the support functions or services requested by Movies Anywhere, but not for other purposes.
  5. Business partners and other third parties: We may share information collected from or about you with carefully selected companies, including advertisers, content licensors, distributors, and other companies that are not affiliated with us, including to provide you with marketing, promotional, updates, and other offers. We will not share personal information with these third parties without your consent.
  6. Sweepstakes, contests, and other promotions: If you choose to enter into one of our sweepstakes, contests, or other promotions (a "Promotion") we may disclose your information to third parties or the public in connection with administering such Promotion, as required by applicable law, as permitted by the Promotion's official rules, or otherwise consistent with the terms of the Movies Anywhere Privacy Policy.
  7. Legal matters; safety; sale or transfer of business or assets: We may share your information with third parties in connection with the sale or transfer of our business or our assets, to enforce our Terms of Use or policies, to ensure the safety and security of our customers and third parties, to protect our rights and property and the rights of third parties, to comply with legal or judicial process, requests from government authorities, or in other cases if we believe in good faith that disclosure is required by applicable law.
  8. Aggregate, anonymous, or de-identified information: We may disclose aggregate, anonymous, or de-identified information about our users and information that does not identify any individual, without restriction, including to third parties for their marketing or analytics uses.
  9. Other: We also may share your information as disclosed to you at the time of collection with your consent.

Once we share your information with business partners and other third parties (e.g., Participating Studios, Digital Retailers, sweepstakes and promotional partners) as described in the Movies Anywhere Privacy Policy (but excluding our Service Providers), the information received by such business partners and other third parties becomes subject to their respective privacy practices and policies.

4. Your Video Data

With your consent, Movies Anywhere may share personal information regarding your Movies Anywhere account, together with your video titles, descriptions, and other video activity information (collectively, "Video Data") with:

  1. Each Digital Retailer to which you connect your Movies Anywhere account and its service providers;
  2. Participating Studios and their affiliates and service providers; and
  3. Service Providers of Movies Anywhere.

You further understand that:

  1. Movies Anywhere and its Service Providers will use your Video Data in accordance with the Movies Anywhere Privacy Policy.
  2. Connected Digital Retailers and Participating Studios will use the Video Data they receive in accordance with their respective privacy policies.
  3. You can manage your Video Data sharing preferences by going to the Video Data Sharing section of your Movies Anywhere settings and following the relevant instructions. You should understand the following about your choice to stop sharing Video Data:
    1. Movies Anywhere may still share your Video Data in the ordinary course of business (e.g., to process your requests and fulfill your orders).
    2. Movies Anywhere may still share information, including about you and your devices, that is not Video Data, as described in the Movies Anywhere Privacy Policy.
  4. Your choice to receive email marketing from Movies Anywhere or Participating Studios is independent of your choice with respect to Movies Anywhere's sharing of Video Data. You can control your email marketing choices by following the marketing email opt-out/unsubscribe instructions provided in the marketing email or described in Section 6 of the Movies Anywhere Privacy Policy ("Your Controls and Choices") under "Electronic Promotional Offers."

5. Your Account and Profiles

To help you access your Movies Anywhere account easily from any of your devices, we use technology that allows us to recognize you so that you do not need to log-in to your account each time you use the Services. If you no longer want us to identify you in this manner, you can log-out of the Services on the applicable device.

If you allow others to access your Movies Anywhere account in accordance with the Terms of Use, please note that the Movies Anywhere Privacy Policy, as well any specific consents you may have provided, also apply to their access, use, and disclosure of information. By allowing shared access to your Movies Anywhere account, you understand that such users will be able to see your account information, videos, preferences, usage of the Services, and other information associated with your Movies Anywhere account (even if you set up different profiles for your account).

You may set up one or more profiles in your Movies Anywhere account to create separate, customized experiences within the Service, including personalized recommendations and separate watch histories. You understand that if you allow others to access your Movies Anywhere account, they will be able to view and modify any profiles associated with your account. As the account holder, you are responsible for maintaining the privacy and security of your account, as well as the usage by those with whom you allow shared access.

6. Your Controls and Choices

In addition to the controls and choices we provide you over Video Data, we provide you the ability to exercise certain controls and choices regarding our collection, use and sharing of your information in connection with the Services. In accordance with applicable law, such controls and choices may include:

Account Information

If you wish to verify, correct, update or delete your account, contact us at the address or e-mail in the "Comments and Questions" section below. If you choose to delete your account, we may still retain certain information for analytical purposes and recordkeeping integrity, as well as to prevent fraud, resolve disputes, enforce our Terms of Use or other policies, take actions we deem necessary due to technical and legal requirements, and as dictated by constraints related to the security, integrity, and operation of the Services.

To update the profiles associated with your Movies Anywhere account, (a) in the Movies Anywhere application, visit the "More" section of your account, and click or tap on "Switch Profiles" and (b) on the Movies Anywhere website, click your name in the upper right hand corner of the site, and then click "Manage Profiles". There you can view and delete profiles listed in your account.

Marketing and Notification Preferences

We provide you with choices to opt out of receiving certain types of marketing messages. To opt-out, you may use one of these methods:

  1. Electronic Promotional Offers. When you register for the Services, you may choose to receive emails from us with updates, offers, and other information related to the Services. If you do not want to continue to receive such emails you may click on the unsubscribe link in the footer of any email. Even if you unsubscribe from receiving such marketing emails, we may still send you transactional emails.
  2. Push Notifications: When you use the Movies Anywhere app, you may choose to receive push notifications. To control whether you receive push notifications, you may adjust your settings on your mobile device.

If you have chosen to receive email marketing from Participating Studios, you can opt-out/unsubscribe individually from each of the Participating Studios from which you are receiving studio-specific email marketing. To do so, please review the instructions provided in the marketing emails sent to you by Participating Studios.

Online Tracking and Advertising and Your Rights

We may use cookies, Web beacons, marketing pixels or other technologies to deliver more relevant advertising and to link data collected across other computers or devices that you may use.

Some states provide residents or, in some cases, their authorized agents, with the right to opt out of the “selling” or “sharing” of their “personal information”, or of “targeted advertising” based on their “personal information.” To submit a request to opt out you may click the “Do Not Sell or Share My Personal Information” link in our website footer or in our application settings. Please note that your opt-out choice is specific to the digital property and to the device and browser you are using. If you clear your cookies on your browser or use another browser or device, you may need to opt out again. Importantly, you may also choose to provide the information requested in this opt out form, which may enable us to take action on your opt-out request more broadly than for a specific digital property, including on properties where you are a registered user.

In addition,Movies Anywhere adheres to the DAA's Self-Regulatory Principles for Online Behavioral Advertising. You may choose not to receive targeted advertising from many ad networks, data exchanges, marketing analytics and other service providers, by visiting the Digital Advertising Alliance's (DAA) opt-out page at http://www.aboutads.info/choices, or the DAA's AppChoices tool at http://youradchoices.com/appchoices. You or your authorized agent may also choose to enable online, where available, a universal tool that automatically communicates your opt-out preferences, such as the Global Privacy Control (“GPC”). We will process the GPC signal as a request to opt out.

Finally, on your mobile device or in your browser or operating system settings, you may also adjust your privacy and advertising settings to control whether you receive more relevant advertising. By doing so, you may not be able to use certain features in the Services or take full advantage of all of our offerings. Changing your online tracking or advertising preferences will not impact collection, use, or sharing of information by Movies Anywhere for other purposes, such as those relating to the access, processing, fulfillment, or delivery of the Services.

8. Third-Party Content, Links, and Plug-Ins

The Services may contain links to other sites and applications not owned or controlled by us and we are not responsible for the privacy practices of those sites and applications. We encourage you to be aware when you leave our sites or applications and to read the privacy policies of other sites and applications that may collect your personal information.

9. Children's Privacy

You must be at least 13 years of age to register for the Services and create an account. The Services are not intended to be used by children without the involvement and approval of a parent or guardian who is a registered user of the Services.

10. Data Security, Integrity, and Retention

The security, integrity and confidentiality of your information are extremely important to us. We have implemented technical, administrative and physical security measures that are designed to protect user information from unauthorized access, disclosure, use and modification. From time to time, we review our security procedures to consider appropriate new technology and methods. Please be aware though that, despite our best efforts, no security measures are perfect or impenetrable. We will retain your personal information for the length of time needed to fulfill the purposes outlined in the Movies Anywhere Privacy Policy unless a longer retention period is required or permitted by applicable law.

11. Data Transfer and Storage

Your personal information may be stored on servers in the United States and is subject to the laws of the United States, which may differ from those of other countries.

12. Privacy Policy Changes

From time to time, we may change the Movies Anywhere Privacy Policy. If any change is material, we will provide appropriate notice to you, and, where required, we will obtain your consent. Notices regarding any material change to the Movies Anywhere Privacy Policy may be delivered by methods such as through your registered email or providing notice on the Services.
